When the EB-5 program lapsed in June of 2021, some EB-5 investors with pending applications for I-526s and Immigrant Visas and Adjustment of Status found their applications held in a lengthy abeyance. With the reauthorization of the EB-5 program in March 2022, USCIS announced it would resume processing these applications, which Greenberg Traurig can confirm. This includes the issuance of I-526 petition approvals filed in the 2018/2019 time frame, biometric notices, Applications for Adjustment of Status, as well as the scheduling of immigrant visa interviews at consulates worldwide for eligible investors.
